Welcome to Rise AI Solutions ("Company," "we," "us" or "our"). These Terms of Service ("Terms") govern your access to and use of our website, services and related materials, including Rise AI Solutions plugins and reusable workflows in ChatGPT.

By accessing or using our website or services, you agree to these Terms. If you do not agree, do not use them.

1. Acceptance of Terms

By using our website or services, you acknowledge that you have read and agree to these Terms.

If you use our services on behalf of an organization, you represent that you have authority to accept these Terms on its behalf.

2. Services Provided

Rise AI Solutions provides virtual voice and messaging solutions, software development, digital marketing, customer relationship management services and consulting. We also provide plugins and reusable workflows for use within ChatGPT.

Specific services, fees and responsibilities may be described in separate client agreements. Where a separate agreement governs a service, that agreement controls if it conflicts with these Terms.

3. Eligibility

You must be at least 18 years old to use our website or services. By using them, you represent that you meet this requirement.

Access to services provided through third-party platforms is also subject to those platforms’ eligibility requirements.

4. Acceptable Use

You agree to use our website and services lawfully. You must not:

Use them for fraudulent or illegal activities

Attempt to gain unauthorized access to accounts, systems or information

Upload or distribute malicious software

Disrupt or interfere with their operation

Upload content that violates another person’s privacy or intellectual property rights

Misrepresent your identity or authority to act for another person or organization

You are responsible for ensuring that information and materials you provide are accurate and that you have permission to use them.

5. Intellectual Property

5.1 Our Materials

Content and materials supplied by Rise AI Solutions, including our branding, website content, software and plugin instructions, are owned by Rise AI Solutions or its licensors unless otherwise stated.

5.2 Permission to Use

Subject to these Terms and any applicable service agreement, you may use our website and services for their intended personal or internal business purposes.

This permission does not authorize you to reproduce, sell or redistribute our proprietary software, branding or service materials without permission.

5.3 User Content and Generated Outputs

You retain any ownership rights you hold in content you provide. Uploading content does not transfer ownership of it to Rise AI Solutions.

Rights concerning content submitted to ChatGPT and generated outputs are governed by OpenAI’s applicable terms and applicable law. These Terms do not grant rights to third-party product images, trademarks or other materials.

6. Third-Party Platforms and Links

Our website and services may link to or operate through third-party platforms, including ChatGPT.

Your use of those platforms is subject to their terms and policies. Rise AI Solutions does not control their availability, features, account requirements or data practices.

A link to a third-party website does not constitute a guarantee of its content or services.

7. Disclaimers

To the extent permitted by law, our website and services are provided “as is” and “as available,” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose or non-infringement.

We do not guarantee that our website or services will be uninterrupted, error-free or suitable for every intended use.

Generated content may contain errors or omissions. You are responsible for reviewing results and verifying information before relying on it.

Any express commitments in a separate service agreement remain subject to that agreement.

8. Limitation of Liability

To the extent permitted by law, Rise AI Solutions will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of our website or services.

Unless a separate service agreement provides otherwise, our total liability arising from your use of the website or services will not exceed the amount you paid Rise AI Solutions for the affected service during the six months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability or limits rights that cannot lawfully be excluded or limited.

9. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Rise AI Solutions and its personnel from claims, losses and reasonable expenses arising from:

Your unlawful use of our website or services

Your violation of these Terms

Content you provide that infringes another person’s rights

10. Suspension and Termination

We may suspend or terminate access to services we control if you violate these Terms or use them in a way that harms others or interferes with their operation.

Termination of services governed by a separate client agreement is subject to that agreement.

Rise AI Solutions does not control suspension or termination of your ChatGPT account or accounts with other external providers. Those providers manage access under their applicable terms.

11. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of laws principles.

Subject to applicable law, legal proceedings arising from these Terms must be brought in courts of competent jurisdiction located in or serving Heber City, Utah.

12. SMS Messaging Terms

When you provide your mobile number and opt in, you agree to receive the SMS messages described in the applicable consent form. These may include appointment confirmations, service updates and promotional messages where you have opted in to receive them.

Message frequency varies. Message and data rates may apply.

You may opt out by replying STOP. For help, reply HELP or contact us at [email protected] or 435-292-8933.

We do not sell or rent your mobile number or share it with third parties for their marketing purposes. We may share it with service providers needed to deliver SMS communications.

Our Privacy Policy explains how we handle messaging information.

13. Changes to These Terms

We may update these Terms as our services change. We will identify revisions by updating the effective date and provide additional notice where required by law.

Changes take effect when published unless another effective date is stated. Your continued use after changes take effect constitutes acceptance of the revised Terms, to the extent permitted by law.

Changes to separate client agreements are governed by those agreements.

15. Rise AI Solutions Plugins in ChatGPT

15.1 Purpose and Scope

Rise AI Solutions provides plugins and reusable workflows that help users perform tasks within ChatGPT. Each plugin’s description explains its intended purpose and supported functions.

These Terms apply to our plugins unless additional terms are provided for a particular plugin. Separate purchased services remain subject to their applicable service agreements.

15.2 Generated Content and Verification

Generated content may contain errors, omissions or inaccurate assumptions. Results are not guaranteed to be complete, accurate or suitable for every intended use.

Users are responsible for reviewing outputs and verifying information before relying on it, making purchases or taking consequential actions.

Plugin outputs do not replace qualified professional advice where such advice is needed.

15.3 Uploaded Content

Users must own or have permission to use the files, photographs and other content they provide.

Do not upload content that infringes another person’s rights. Avoid including sensitive personal information unless it is necessary for the intended task and you are authorized to provide it.

Uploading content does not transfer ownership of it to Rise AI Solutions. Rights concerning content submitted to ChatGPT and generated outputs are governed by OpenAI’s applicable terms and applicable law.

15.4 ChatGPT and External Services

Access and functionality depend on OpenAI’s available features, account requirements and service availability. Use of ChatGPT is subject to OpenAI’s applicable terms and policies.

Some plugins may require external services or connections. Their availability, permissions and additional terms will be identified where applicable.

Rise AI Solutions does not control third-party platforms, account settings or service availability.

15.5 Information Handling

Our Privacy Policy and any applicable plugin-specific disclosures explain how information is handled.

For plugins that operate entirely within ChatGPT without external connections, Rise AI Solutions does not receive, access or retain uploaded content or generated outputs through the plugin.

Plugins with external connections may transmit information as described in their applicable disclosures.

If you separately provide information to Rise AI Solutions for support, our Privacy Policy applies to that information.

15.6 Fees

Any Rise AI Solutions fees for a plugin or related service will be disclosed before purchase. Separate purchased services are governed by their applicable agreements.

OpenAI determines any fees associated with ChatGPT accounts or features. External providers may charge their own fees under their terms.

Rise AI Solutions does not currently charge users through Tile & Surface Visualizer.

15.7 Availability and Changes

We may update or discontinue our plugins. Features may also change as ChatGPT or connected services evolve.

We do not guarantee uninterrupted availability or that any particular feature will remain available.

15.8 Additional Terms for Tile & Surface Visualizer

Tile & Surface Visualizer creates conceptual images to help users compare tile, stone, flooring and other surface materials in photographed spaces.

Images may contain inaccuracies in material appearance, color, dimensions, grout spacing, room geometry or installation details. We do not guarantee an exact product match, preservation of every room feature or a particular finished appearance.

Images are not architectural drawings, measured installation plans, quantity estimates or construction specifications.

Before purchasing materials or beginning work, users must confirm measurements, product specifications, quantities, material suitability and installation requirements with their supplier or qualified contractor.

The plugin does not replace professional advice concerning construction, waterproofing, structural conditions, accessibility or building codes.

Uploading a product reference does not imply endorsement by or affiliation with its manufacturer.
